The Appeals Process

The application is usually reviewed by the State Disability Determination Services office - the same office that considered the initial application.
  • Appeals council — The next step in the appeals process involves an appeals council. If the application was denied at the administrative hearing, the appeals council will assess the decision made at the administrative hearing. The council can either make a decision itself, or send the case back to an administrative hearing.
  • Federal district court — If the claimant disagrees with the decision made by the appeals council, he or she can take the case to the federal district court. There, the federal district court judge will deny or approve benefits, or send the case back to the administrative hearing level.
