The Social Security Disability Insurance Claims Process

  • Application - First, the applicant completes an extensive application. The application must include medical information explaining the disability and its daily impact. This must be provided by a doctor. In most cases, the determination is made within 6 months. The majority of claims are denied at this level.
  • Reconsideration - If the claim was denied, the applicant can appeal the decision at the reconsideration level. The decision to approve or deny benefits through SSDI is made by the Social Security Administration.
  • Administrative hearing - If the reconsideration is denied, the applicant can make a second appeal which is handled in an administrative hearing. At this level, the decision to approve or deny benefits is made by an administrative law judge.
  • Appeals council - If the second appeal is denied at the administrative hearing level, the process moves up to be reviewed by the appeals council. This council will look to see if any legal points were missed at the administrative hearing.
  • Federal district court - The final level of appeal is in federal court. However, if the federal district court denies the claim, it can be sent back for an additional administrative hearing.
